Gym Accidents and Gym Injuries
If you have been involved in a gym accident or suffered a gym injury we can advise you on whether you can bring a claim or not.
Anybody who goes to a gym or sports centre knows that the equipment can often be difficult to operate. If you don’t know what you are doing it can cause you injury well as (hopefully) making you fit.
How do you know if you can bring a claim?
There are two main things to consider:
1. The training and instruction that you were given when you started.
If it is the first time you have used a gym you should be offered what is know as ‘induction training’. This is when one of the staff or fitness trainers should show you how to use all the equipment in the gym safely
You should be taken around all equipment and staff should make sure that you understand how each piece of equipment is used. After doing so they will ask you to fill out a form saying that you have been shown and understand how to use all of the equipment. This document is very important as it may be the critical bit of evidence in bringing a claim if that becomes necessary. Ensure that you make sure that you fully understand what you are signing.
2. What caused the accident- was it faulty equipment or lack of training?
This is where it is vital you get specialist advice as expert evidence to support your claim may be needed. We can tell you if this will be necessary
What are the main causes of Gym Accidents or Gym Injuries?
Using gym equipment, such as weights, it can be extremely dangerous, especially on the bench press. If you don’t release a weight properly you could become injured. As well as being properly trained the management of the gym need to ensure that a fitness instructor is present at all times when using the gym a It is their job to make sure everyone is using the equipment correctly, and that there are no hazards, such as spillages or broken machines.
What should I do if I have been involved in a Gym Accident or Gym Injury?
If you have been involved in a gym accident you should let a member of staff know as soon as possible. A trained First Aider should be present to attend your injuries. There will also be an Accident Report Book which will need to be completed. You should make sure that you take the names and addresses of any staff that come to help and also get names of any people who may have witnessed the accident in case the details are questioned later.
